Virginia Sex Offender Registration Requirements

Virginia's sex offender registration law is in Virginia Code Title 9.1, Chapter 9. Three tiers apply based on the type of offense. Tier I offenders register once a year for 15 years. Tier II offenders register once a year for 25 years. Tier III offenders register every 90 days for life. The tier is set at sentencing and does not change based on conduct after conviction.

Any person convicted of a qualifying offense must register within three days of release from incarceration. If no incarceration was ordered, registration is due within three days of sentencing. Address changes must be reported within three days. Changes to an email address or online username must be reported within 30 minutes. The complete statutory requirements are available at law.justia.com/codes/virginia/title-9-1/chapter-9.

Failing to register is a Class 1 misdemeanor for Tier I and Tier II offenders. For Tier III, it is a Class 6 felony. Tier III offenders also face location restrictions and may not live, work, or loiter within 500 feet of any school or daycare in Virginia.

Note: Registration tier is fixed at sentencing by the court, not the offender's behavior afterward. Moving from one county to another does not change the tier or reset the registration clock.

What the Registry Shows for Isle of Wight Offenders

Each entry in the Virginia Sex Offender Registry lists the person's full legal name, current home address, date of birth, a photo taken at registration, and the offense that required registration. The listing also shows the tier level and when the next check-in is scheduled. Offenders employed at a different location may have a work address listed as well.

Transient offenders, those without a fixed address, show a general location or last known area. If an address looks outdated or wrong, it may mean the person failed to report an address change. That is a compliance violation. Report it to the VSP at (804) 674-2825. The Isle of Wight County Sheriff's Office conducts regular address verification to catch non-compliance.

The National Sex Offender Public Website (NSOPW) covers all 50 states. If someone recently moved to Isle of Wight County from another state, NSOPW can confirm whether they had a prior registration elsewhere. Free and open to the public.
