Virginia Sex Offender Registration Requirements

Virginia's registration law is in Virginia Code Title 9.1, Chapter 9. The law uses three tiers based on offense type. Tier I requires annual registration for 15 years. Tier II requires annual registration for 25 years. Tier III requires registration every 90 days for life. The tier is set at sentencing and does not change based on post-conviction behavior.

Registration must happen within three days of release from incarceration or, if no jail time was ordered, within three days of sentencing. Address changes must be reported within three days. Changes to email addresses and internet usernames must be reported within 30 minutes. These rules appear in the statute at law.justia.com/codes/virginia/title-9-1/chapter-9 and apply in every Virginia county, including Essex.

Failing to register is a Class 1 misdemeanor for Tier I and Tier II. For Tier III, non-compliance is a Class 6 felony. Tier III offenders also cannot live, work, or loiter within 500 feet of a school or childcare facility anywhere in Virginia.

Note: Once a person is placed on Tier III, the lifetime registration requirement applies regardless of which county they live in or later move to.

What the Registry Entry Shows

Every registry entry includes the person's full legal name, current address, date of birth, a current photo, and the offense that put them on the registry. The tier level and next check-in date also appear. Some entries list both a home and a work address when employment is elsewhere.

Transient offenders without a fixed address appear with a general location or last known address. If an entry looks outdated, a required update may not have been filed. That is a compliance violation. Report it to VSP at (804) 674-2825. The Essex County Sheriff's Office conducts regular address verification as part of its standard enforcement work.

The National Sex Offender Public Website (NSOPW) runs a nationwide search across all 50 state registries. It is free and does not require an account. Use it when checking someone who may have been registered in another state before moving to Essex County.
